Sex with Danny Masterson was 'never loving' model tells rape court

 Sex between TV star Danny Masterson and his live-in girlfriend – and alleged rape victim – was ‘never loving’ during their six years together, she told the jury at his rape trial Thursday.

Instead, ‘it was rough and forceful,’ Jane Doe #3 said during her third day in the witness box.

‘He did not understand that a woman needs to be prepared – not just jump on and do it their way.’

Asked during cross examination by defense attorney, Philip Cohen, if Masterson would keep on asking for sex, even when she said no, she told the court, ‘He wouldn’t ask. There was no asking – he would just do it.’

Masterson, 46 – who has been free on $3.3 million bail since his arrest in June 2020 – has pleaded not guilty to raping three women at his Hollywood Hills home between 2001 and 2003.

The Scientologist actor is facing a sentence of 45 years to life in prison if he’s convicted at the end of his trial where Elvis Presley’s daughter, ex-Scientologist Lisa Marie Presley, is on the witness list.

His accusers – whom DailyMail.com is identifying only as Jane Does 1 through 3 – are all former Scientologists and are also suing him and the Church of Scientology in civil court, claiming that they’ve been harassed and intimidated since reporting him to police.

Masterson – who starred on TV’s That ’70s Show – showed up Thursday at the criminal court in downtown Los Angeles in a gray suit, blue shirt and gray striped tie.

The case resumed Thursday after a day off. Defense lawyer Cohen opened his cross examination by questioning Jane Doe 3 about the 1997 night she earlier testified to in which she returned from a modeling assignment in Paris and she and Masterson had a big fight about her not wanting to have sex with him.  

When the attorney asked her what she had said to Masterson that night that made him mad, she said, ‘I told him I had slept with somebody else – which was not true.’

But when Cohen then asked who she told him she had slept with, Judge Charlaine Olmedo interrupted, saying, ’That’s irrelevant.’

Later, during a a brief sidebar with the jury out of the courtroom, Cohen revealed that it was Masterson’s brother whom Jane Doe 3 had claimed to have slept with.

The judge told him, ‘I understand your argument that the brother makes it more egregious……but it’s still not relevant.’

When the attorney asked her what she had said to Masterson that night that made him mad, she said, ‘I told him I had slept with somebody else – which was not true.’

But when Cohen then asked who she told him she had slept with, Judge Charlaine Olmedo interrupted, saying, ’That’s irrelevant.’

Later, during a a brief sidebar with the jury out of the courtroom, Cohen revealed that it was Masterson’s brother whom Jane Doe 3 had claimed to have slept with.

The case against Masterson involving Jane Doe 3 centers on two incidents. The first was in November 2001 when she says she woke to find him having sex with her and when she said no and tried to fight him off, he hit her in the face. This is the basis of the rape charge Masterson is facing.

The second – which he is not charged with – was in December 2001 when, she claims, Masterson raped her anally while she was unconscious.

Under cross examination, Jane Doe 3 admitted that the November 2001 incident was the ‘only time during their five-plus years together’ that the actor struck her.

Cohen raised discrepancies between her testimony – in which she said Masterson hit her on her left cheek with the side of his closed fist – and a later interview with a detective in which she said he ‘slapped’ her face.

All the alleged rapes are said to have taken place in Masterson’s $6.2 million mansion in the Hollywood Hills

When asked, ‘Would it be accurate to say that during your relationship, Masterson never threatened to hit you?’ she answered, ‘There were times when it felt like he was going to. But I don’t know.’

In 2016, Jane Doe 3 finally went to the police in Austin, Texas – where she was living at the time – to report Masterson.

‘You were there to report a sexual assault from December 2001, correct?’ asked Cohen.

‘I believe I said I was there to report a rape,’ she replied.

‘You were referring to the December 2001 sodomy,’ right? said Cohen

‘He raped me – it was extremely damaging to me,’ she answered.

‘You made no mention (to Austin Police) of the November incident, correct? asked Cohen.

‘They did not ask me about other things,’ responded Jane Doe 3.

Cohen asked her if she reported ‘sodomy or anal rape that occurred in December 2001’ in a later interview she gave to Los Angeles Police Department Detective Esther Reyes.

‘Yes sir,’ she replied. ‘But I never referred to it as sodomy.

‘If someone has sex with you when you are unconscious, that is rape sir.’
