They are granted in cases where individuals are no longer able to make their own decisions, such as suffering from dementia.

Thomas Sr has had multiple health issues over recent years and suffered from a stroke in May.

If allowed, the move would permit Tom Jr, 55, to manage a court case against British photographer Jeff Rayner over staged photos which caused Thomas Sr ‘worldwide embarrassment’.

An unnamed source told the Sunday Mirror: ‘Tom Snr has had a series of health scares and his son wants to do the best for him by taking any stress away.

‘Cases in America grind on for months or years so it will be a weight off Tom Snr’s mind. It will help him focus on his recovery.’

The photographs were taken before the Prince Harry and Meghan’s wedding and led to the relationship between the father and daughter breaking down.

According to Thomas Sr, the photographs were staged in order to help change his public persona.

He said in a Channel 5 documentary: ‘The idea was that these would all be candid shots, discreet, no one would know they were posed or anything.

‘It would just be me doing my routine daily.’

Thomas Sr has even been quoted saying in a book he would consider killing Mr Rayner, leading the photographer to take out a restraining order on the former Hollywood lighting engineer.

Meghan Markle has not spoken to her father since he staged photographs with paparazzi before Prince Harry and Meghan’s wedding. Thomas Sr did not attend the wedding due to suffering from a heart attack

In the book Revenge: Meghan, Harry and the War Between The Windsors, author Tom Bower claimed Thomas Sr said: ‘I got screwed Rayner… I want to tear him down. If they tell me I’ve got terminal cancer, then I’ll kill him because I have nothing to lose.’

Thomas Sr has denied saying he would kill Mr Rayner and will appear in court in November to seek $1 million for the damage the staged photographs caused.

Mr Rayner’s photography company, Coleman-Rayner, issued a statement saying: ‘Mr Markle’s hand-written court filing is so obviously frivolous that Mr Markle and anyone else who republishes the details of Mr Markle’s court filing, will be liable to Coleman-Rayner for defamation.’

Meghan has not spoken to her father since the staged photographs and Thomas Sr did not attend the wedding due to suffering from a heart attack.

He is also yet to meet Meghan’s children Archie, three, and Lilibet, one.
